Abortion and the Texas Law
A pregnant woman in Texas may have an abortion up until she is 24 weeks or 6 months pregnant. A woman may have an abortion after 24 weeks only if there is a medical emergency.
Currently, teenagers under 18 are able to consent to an abortion on their own. However, the state requires notification of at least one parent or legal guardian prior to the abortion being performed in Texas.
As of September 2005, teenagers under the age of 18 will be required to obtain written consent from one of their parents or legal guardians prior to an abortion being performed in Texas.
For some pregnant teens, telling a parent or legal guardian of a decision to have an abortion can cause abuse, homelessness, or abandonment. If a minor is unable or unwilling to tell her parent or legal guardian about her decision to have an abortion, Jane's Due Process can help the minor request a judicial bypass from the court.
